Fairtex EU Exchange & Return Policy

This policy applies to purchases made through the Fairtex EU online store.

Nothing in this policy limits or excludes statutory rights granted under applicable EU consumer protection law.

 


 

1. Quality Control

All Fairtex products undergo a strict two-stage Quality Control process:

• Initial inspection at our production facility
• Final inspection at our EU warehouse prior to dispatch

All products leave our warehouse in new, unused, and fully functional condition.

 


 

2. Statutory Right of Withdrawal (EU Customers)

In accordance with Directive 2011/83/EU, customers have the right to withdraw from their purchase within 14 calendar days of receiving the goods.

To exercise this right:

• Notification must be sent in writing within 14 days of delivery
• Goods must be returned within 14 days of notification

Returned products will be inspected upon receipt.

Customers are liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.

 


 

3. Combat Sports & Hygiene-Sensitive Products

Fairtex products are designed for high-intensity athletic use. Due to hygiene and safety considerations, the following are considered use beyond inspection:

• Training sessions
• Bag work or sparring
• Exposure to perspiration
• Odor inside gloves or protective equipment
• Interior creasing from impact
• Visible compression of padding
• Deodorant, makeup, or animal hair contamination

Items showing such signs may:

• Be subject to a reduced refund reflecting diminished value
• Be refused if no longer in resalable condition

Hygiene-sensitive products, including but not limited to mouthguards, groin protectors, and hand wraps, cannot be returned once unsealed for health and safety reasons.

 


 

4. Return Destination, Labels & Fees

All approved returns must be sent to our warehouse in The Netherlands.

Upon approval, Fairtex will provide a prepaid return shipping label.

Return Fees

• A €5 return label fee will be deducted from the refund
• A 10% restocking fee applies to returned items

The restocking fee covers inspection, sanitation review, repackaging, and reintegration into inventory.

Original outbound shipping costs are refunded only if Fairtex made a confirmed fulfillment error.

 


 

5. Exchanges

• No restocking fee applies to exchanges
• A €10 exchange handling fee applies
• Customers are responsible for any product price differences

Exchange items are dispatched after inspection and approval of the returned item.

 


 

6. Conditions for Accepting Returns

To qualify for return or exchange, items must:

• Be returned within the applicable period
• Be unused and unwashed
• Be free from sweat, odor, stains, or visible wear
• Include original packaging and all tags

Fairtex reserves the right to:

• Refuse returns that do not meet these conditions
• Apply a partial refund reflecting diminished value
• Document the condition of returned goods for internal records

Products that cannot be resold due to hygiene or safety concerns may be rejected.

 


 

7. Custom & Personalized Products (Non-Returnable)

In accordance with Article 16(c) of Directive 2011/83/EU, the statutory right of withdrawal does not apply to goods that are made to the customer’s specifications or clearly personalized.

The following products are considered custom or personalized and are non-returnable:

• Shorts with embroidered names or custom text
• Personalized glove embroidery
• Custom-designed shorts
• Special color combinations produced upon request
• Made-to-order production runs
• Any item manufactured specifically according to customer-provided specifications

Once production has begun, custom or personalized orders:

• Cannot be cancelled
• Cannot be refunded
• Cannot be exchanged

Custom products are manufactured specifically for the customer and cannot be resold.

Returns will only be accepted if a verified manufacturing defect is confirmed upon inspection.

Incorrect sizing resulting from customer-provided measurements, selection errors, or failure to review the size guide does not constitute a manufacturing defect.

By placing an order for a custom or personalized product, the customer expressly acknowledges and agrees that the statutory right of withdrawal does not apply to that order.

 


 

8. Suspected Manufacturing Defects

If you believe an item has a manufacturing defect, contact customer service with clear photos or video evidence.

The product must be returned for inspection.

After inspection:

• If a manufacturing defect is confirmed, Fairtex will replace the item at no cost and reimburse reasonable return shipping expenses
• If no defect is found, the item will be returned to the customer and shipping costs remain the customer’s responsibility

Damage caused by impact, misuse, improper storage, natural wear, or excessive training use is not considered a manufacturing defect.

 


 

9. Genuine Leather Characteristics

Many Fairtex products are crafted from authentic natural leather.

The following are normal characteristics and not defects:

• Natural grain variations
• Subtle creases or wrinkles
• Minor texture differences
• Natural marks in the hide

These characteristics do not affect durability or performance.

 


 

10. Shipping & Processing

Orders are dispatched from our EU warehouse within 3–5 business days.

Delivery is handled by carriers such as UPS or DPD.

Estimated transit time is 5–7 business days.

Carrier delays, customs inspections, weather conditions, or force majeure events are outside Fairtex’s control.

 


 

11. Customer Responsibilities

Customers are responsible for:

• Reviewing the size guide prior to purchase
• Understanding that some items follow Asian sizing standards
• Contacting customer service if unsure about sizing
• Properly packaging returned items
• Including their order number in the parcel

Incorrect size selection does not constitute a defect.

 


 

12. Product Liability Coverage

Fairtex maintains appropriate product liability insurance as required under EU and Dutch law. This coverage ensures compliance with safety and consumer protection regulations.

 


 

13. Limitation of Liability

To the fullest extent permitted by law:

• Fairtex is not liable for indirect, incidental, or consequential damages arising from product use
• Total liability shall not exceed the purchase price of the product concerned

Nothing in this clause limits liability where prohibited by law.

 


 

14. Governing Law

This policy is governed by the laws of The Netherlands and applicable EU legislation.

Consumers may access the European Commission Online Dispute Resolution platform where applicable.
